Did you know that one of the key responsibilities of every owner of a transport company is to keep records of drivers’ working hours?
\nThis is not only a matter of safety for all traffic participants, but also a requirement under current labor laws and regulations for professional drivers. <\/p><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

How to keep driver time records and for whom is it mandatory? <\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Keeping time records applies to every driver, regardless of the form of employment.
\nA personal time record card should be prepared for each employee, on which all the driver’s activities, vacations and days off are recorded.
\nIt should be noted that this task is not easy, due to the dynamic nature of drivers’ work, where it is often impossible to accurately determine the start and end times. <\/p>\n

Properly kept time records not only allow you to determine wages, but most importantly provide control over the driver’s working time, ensuring safety on the road through adequate breaks and rest.
\nMoreover, the records must comply with the requirements of the Mobility Package. <\/p><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Driver time records and the Mobility Package <\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The Mobility Package introduced significant changes to driver time records.
\nAs of May 29, 2022, the records can be kept in both paper and electronic form.
\nThe employer is required to keep it for 10 years, and must make it available to the employee upon request.
\nThe records should be complete, legible and always ready to be shown to the controlling authorities. <\/p><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

What should a correct driver time record contain? <\/h1>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t

Full records must include:<\/p>\n

    \n
  • Start and end times<\/li>\n
  • Number of hours worked during the day, including night hours<\/li>\n
  • Overtime<\/li>\n
  • On-call time, including whether the driver performed it at home<\/li>\n
  • Information on the types and extent of exemptions, excused and unexcused absences<\/li>\n<\/ul>\n

    All this information must be consistent with source materials, such as readings from driver cards, tachographs, record sheets or other documents proving the time and type of work performed.<\/p><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    Yes, the obligation to keep records applies to all carriers, even those using vehicles with a GVWR of up to 3.5 tons or performing transportation for own use.<\/p><\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    Lack of or improper record-keeping can result in serious financial penalties, especially during inspections by the State Labor Inspectorate.
    \nFines can be as high as tens of thousands of zlotys, so it is worth taking care to keep records properly. <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
